These Terms of Service (“Terms”) govern your use of trinktz.com, app, and any purchases you make through it. By using our website or placing an order, you agree to these Terms.

1. About Us

Trinktz Pty Ltd (“Trinktz”, “we”, “us”) operates trinktz.com, and app, a licensed merchandise and collectibles platform for independent IP holders. We are based in Australia.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By purchasing, you confirm that you meet this requirement.

3. Products

All products are officially licensed. Product descriptions, images, and specifications are provided in good faith. Minor variations in colour, finish, or scale may occur between promotional imagery and the final manufactured product; this is inherent to collectibles produced in limited quantities and does not constitute a material defect.

Trinktz reserves the right to cancel or modify any product listing at any time prior to a campaign closing or an order being fulfilled.

4. Orders and Payment

Placing an order

An order is confirmed when you receive an order confirmation email. We reserve the right to cancel orders at our discretion (e.g. where fraud is suspected or a product is unavailable), in which case a full refund will be issued.

Payment

We accept major credit and debit cards via WooPayments, PayPal, and Afterpay (AUD only). Payment is taken in full at the time of order, except for pre-fund pledges (see Section 5).

Pricing

Prices are shown inclusive of applicable taxes. Prices may change without notice. The price displayed when you place your order is the price you pay.

5. Pre-Fund Campaigns

What pre-funding means

Pre-fund campaigns are to ensure minimum production quantities are met before a pre-order campaign begins, or any product manufacturing begins. You pay a small non-refundable deposit (the “pledge”) to back a campaign and receive a digital collectible item that you keep even if the pre-fund campaign is unsuccessful. The pre-fund is processed as a completed purchase (not a pre-authorisation) and is also your commitment to pay the remaining balance for the full price of the final item if the pre-fund campaign reaches the campaign goal.

Campaign success

If a pre-fund campaign reaches its goal, you will receive an email with a link to pay the remaining balance for the full product at a pre-fund-exclusive price. This balance payment is processed as a separate, and additional independent transaction. If you do not make this payment by the time the pre-order campaign completes you will lose access to the pre-fund exclusive price and will not receive the final product. Once a campaign succeeds and a balance payment link is issued, no refunds are available once the product is in production, except in the case of manufacturing defect or our failure to fulfil.

Campaign failure

If a pre-fund campaign does not reach its goal, no further charge is made. The pre-fund is a completed purchase, you receive the digital collectible, and it is non-refundable as a rule. This must be understood before pre-funding. If a refund is issued for any reason, and a request is received within 14 days from pre-fund campaign failure notification, a cash refund will be issued less the payment processing fee (approximately $0.90 AUD, but subject to change).

6. Cancellations

In-stock and pre-order: you may cancel within 24 hours of placing your order, provided the order has not yet been dispatched. Contact support@trinktz.com with your order number.

Pre-funds: cannot be cancelled once placed during an active campaign.

Pre-order balance payments (post-campaign): cannot be cancelled once the product is in production.

7. Shipping

We generally ship worldwide from Australia, unless specified by product. Shipping costs are calculated at checkout. Estimated delivery times are not guaranteed. You are responsible for any customs duties or import taxes in your country. See our Shipping & Returns page for full details.

8. Returns and Refunds

We do not accept change-of-mind returns. Our products are officially licensed, limited-edition collectibles produced in exact quantities — there is no surplus stock.

Refunds are issued for: faulty or defective products, items significantly different from their description, items that do not arrive. See our Shipping & Returns policy for the full process.

Nothing in these Terms limits your rights under the Australian Consumer Law or equivalent non-excludable legislation in your jurisdiction.

9. Digital Products

Digital items (game keys, licence keys, digital collectibles) are delivered to your account immediately after payment confirmation. Once issued, digital products are non-refundable. If a key is faulty at delivery, contact us within 7 days for a replacement.

10. Store Wallet

Any store wallet credit is issued by Trinktz and may only be used on trinktz.com. It cannot be withdrawn as cash or transferred. Wallet credit has no expiry. We reserve the right to cancel wallet credit issued in error or as a result of fraudulent activity.

11. Intellectual Property

All content on trinktz.com, including text, images, logos, and product designs, is protected by intellectual property law. Product designs are owned by or licensed from the respective IP holders. Nothing on this site grants you any licence to use, reproduce, or distribute that content without our written permission.

12. Limitation of Liability

To the maximum extent permitted by law, Trinktz is not liable for any indirect, incidental, special, or consequential loss arising from your use of our Service. Our total liability for any claim is limited to the amount you paid for the relevant order.

Nothing here excludes rights under the Australian Consumer Law or equivalent non-excludable legislation, or limits our liability for fraud, intentional misconduct, or gross negligence.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the Victorian courts. Customers in the EEA or UK retain the right to bring claims under applicable local consumer protection law.

14. Third-Party Services

Our Service may link to or integrate with third-party platforms. We are not responsible for their content, privacy practices, or terms. You interact with them at your own risk.

15. Updates to These Terms

We may update these Terms at any time. Material changes will be notified by email or website notice. Continued use after changes take effect constitutes acceptance.

16. General

If any provision is found invalid, the remaining provisions continue in full force. These Terms are the complete agreement between you and Trinktz regarding the Service.
